APPLE SUED BY MUSIC FAN
A music fan has hit back at Apple over a $1.29 Adam Lambert tune. Robert Herskowitz was enraged after he was billed twice for downloading ‘Whatya Want From Me?’ from iTunes, who refuse to refund the paltry sum. Herskowitz decided that enough was enough, and took action on behalf of any other wronged parties by filing a class-action lawsuit against the computing giant.
The lawsuit states, “[Apple] ‘double billed’ customers for purchases made through the Apple Stores. Even more troubling, Apple has implemented a policy and practice of refusing to refund the extra charge to customers who have been over billed, causing their credit cards or PayPal accounts to be billed twice for a single purchase.”
Apple had defended their refund refusal, saying, “Your request for a refund for Whataya Want from Me was carefully considered; however, according to the iTunes Store Terms of Sale, all purchases made on the iTunes Store are ineligible for refund. This policy matches Apple’s refund policies and provides protection for copyrighted materials.”
While it remains to be seen how far the lawsuit can progress against Apple’s policies, the question has to be asked, ‘what price customer service?’
